§ 1 Scope
These Terms and Conditions apply to all transport contracts between MG GROUP, owner Muhammad Ijaz-Ud-Din Ghumman, Im Bangert 20, 63450 Hanau, Germany ("MG GROUP", "we") and its customers ("passenger", "you") concluded via the website mg-rides.com, by phone, or via WhatsApp.
§ 2 Description of services
MG GROUP operates licensed chauffeured hire-car transport ("Mietwagenverkehr") under § 49 of the German Passenger Transportation Act (PBefG) and offers, among others: airport transfers, private transport, business travel, medical transport, group travel (up to 6 passengers), and long-distance journeys within Germany and neighbouring countries. Each journey is governed by the trip order confirmed during booking.
§ 3 Formation of the transport contract
Your booking request via our website, by phone, or via WhatsApp constitutes an offer to enter into a transport contract. The contract is only formed once we expressly confirm your booking. There is no entitlement to the journey being carried out prior to confirmation. After we receive your booking, you will first receive an automatic acknowledgement email; this does not yet constitute acceptance of the contract.
§ 4 Prices
The fare is calculated before you confirm your booking, based on distance, estimated travel time, and the currently applicable tariff table, and is communicated to you as a fixed price. Every booking additionally includes a €5.00 booking fee. The price communicated to you is binding and does not change due to traffic conditions or waiting times within the usual range. Where waiting time at the pickup location exceeds the usual grace period, an additional waiting-time fee may apply according to the currently applicable tariff list; this will be communicated to you in advance on request.
All stated prices are final prices inclusive of statutory VAT. On request, we will issue an invoice showing VAT separately along with our VAT identification number.
§ 5 Payment
At the time of booking, you may choose to pay online by credit/debit card via the payment service provider Stripe, or to pay in cash or by invoice directly with the driver after the journey. For online payments, the amount then due (the booking fee and/or the fare) is processed directly through Stripe. For details on how your payment data is processed, see our privacy policy.
§ 6 Vehicle
Transport is generally provided using a BMW 220d xDrive Gran Tourer (up to 6 passengers, non-smoking, air conditioning, child seat on request). We reserve the right to use an equivalent replacement vehicle in individual cases where operationally necessary.
§ 7 Passenger obligations
You agree to be ready at the agreed pickup location at the agreed time, to provide correct pickup and drop-off addresses, and to follow the driver's instructions for safety reasons. The vehicle is non-smoking. Luggage should match the amounts stated at booking; please notify us in advance of any significant deviation.
§ 8 Cancellation and no-show
You may cancel a confirmed booking free of charge if you do so in good time before the agreed pickup time. In the case of short-notice cancellation or no-show, a reasonable cancellation fee may be charged.
[Note for the operator: please define concrete cancellation deadlines and fees and add them here.]
§ 9 Cancellation by MG GROUP
In exceptional cases (e.g. vehicle breakdown, force majeure), we may cancel a confirmed journey. In this case, we will inform you without delay and fully refund any payments already made, to the extent the journey was not carried out.
§ 10 Liability
We are liable without limitation for damages arising from injury to life, body, or health, and in cases of intent or gross negligence. Beyond that, we are only liable for breach of a material contractual obligation, and limited to the foreseeable, typical damage. Statutory liability under the Passenger Transportation Act and our mandatory insurance as a hire-car operator remain unaffected.
§ 11 Force majeure
We accept no liability for delays or cancellations caused by circumstances beyond our control (e.g. traffic disruptions, extreme weather, official orders), provided we are not at fault. In such cases, we will endeavour to offer a reasonable alternative.
§ 12 Data protection
Information on how we process your personal data can be found in our privacy policy.
§ 13 Consumer dispute resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not obliged, and not willing, to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as this is not precluded by mandatory consumer-protection provisions of your habitual place of residence. Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
